Verdict
TrueWhat we checked
TRUE. The original report contains the finding; AREB attributes it to BPA accounts formally in its name. The Tribunal maintains its observation.
The investigation
AREB report at 31/12/2024, page 27: a bank confirms €144m in deposited balances absent from AREB assets. Pages 8 and 42 note missing BPA accounts, limiting risk assessment. Page 53 maintains the observations after AREB’s reply. The report does not say the money has disappeared.
Context
Formal account ownership, beneficial ownership and recorded assets are distinct. An accounting discrepancy does not establish theft.
Right of reply
In its reply dated 03/02/2026, pages 49–50, AREB says these are historic BPA accounts formally in its name after the Vall Banc sale, without availability for AREB. It announces reconciliation and checks. This is its explanation; the Tribunal maintains the finding.
How we reached the verdict
The amount and audit finding are established in the primary document, with the reply and limitations.
Limitations and unavailable information
Definitive ownership, current reconciliation and criminal liability are not certified. No ruling establishing missing money has been located. Claims of theft or disappearance would exceed this evidence.
