On April 2, 2023, Andorra held a general election that should have been protected by the full force of the rule of law. Instead, this episode investigates one of the darkest democratic questions in modern Andorran politics: how could 9,010 early judicial votes — nearly half of the political will of the country — end up stored for days in recycled cardboard boxes, sealed with ordinary packing tape, with the voters’ names and surnames attached to the envelopes?
This is not a story about cheap office material. It is a forensic reconstruction of an electoral chain of custody that, according to the legal dossiers analysed in this episode, may have broken the secrecy of the ballot, destroyed traceability and contaminated the legitimacy of the entire result.
We follow the case step by step: the early vote at the Batllia, the absence of judges at the moment of delivery, the use of nominative outer envelopes, the fragile cardboard boxes, the transport to polling stations, and the decisive moment when those votes were mixed with the ordinary ballots. Once mixed, the damage could no longer be isolated. This is the logic of the “fruit of the poisonous tree”: if the source is contaminated, everything that flows from it becomes politically and legally suspect.
The episode also examines the so-called “deposit theory” and the alleged “right of repentance” — the idea that these were not definitive votes, but temporary deposits that voters could later withdraw or change. According to the sources, no such legal mechanism existed. If the vote could not be taken back, then it was already a vote. And if it was already a vote, keeping it for days with the voter’s identity visible was a direct assault on ballot secrecy.
We also analyse Emili Campos’s challenge, the request for CCTV footage, access logs and custody evidence, the role of Judge Xavier Colom, the conflict-of-interest questions, the majority obtained by Demòcrates per Andorra, and the rapid rejection in Strasbourg by Judge María Elósegui Itxaso, raising serious questions about the appearance of impartiality in a state co-headed by the Episcopal Co-Prince.
This episode is not only about 2023. It is a warning about the future. If cardboard boxes, visible names and missing verification were tolerated once, what happens when Andorra moves toward digital voting, where the box disappears, the envelope disappears, and only servers, code and institutional trust remain?
A democracy cannot survive on blind faith. It survives on verifiable guarantees.
